You should absolutely, positively have a reputable title/escrow firm (preferably local, but not necessarily), do a title search, however, you can do that after you have submitted your offer, and the seller has accepted, as in the contract, it will stipulate that your purchase will be contingent on the seller delivering clean title.

Question - I was thinking that since it's a month-to-month lease (and the state of CA requires I give 60 day notice to terminate a lease that's been in place over a year), I might just try and work something out with a 60 day notice -- and that if he leaves and the unit is in good shape when he delivers it back, he gets his deposit - plus an additional $300 or something like that.

So do you think it's always good to have buyers on hand because I have been hearing it's better to get the sellers on hand first than get buyers but to me it seems like it would be logical to have buyers on hand because what if you have a deal & a seller but can't find a buyer & also risking a lawsuit because you told the seller you can find a buyer but can't deliver?
