When the bank who owns the mortgage forecloses to remove the title owners name - it will be recorded as in rem judgment and will be recorded in public records which will damage your credit.

If it's just your own, that's one thing (although it's still worth talking to a lawyer about, especially if this is a business that's open to the general public and not just select investors you meet and develop relationships with), but if you're placing other private loans or things like that, you definitely need a license and all that jazz.
