Fair or not these are the common practices and if you want to be nice about it, be nice later when they want to move out, not during signing.The only thing you need to sell your room, is the living space itself, safety and maybe a little peace and quite.

If the tree is dying or visible causing a safety hazard, you should be able to contact the town and they may put appropriate pressure.

Check texas law but I believe you would be within your rights to inspect even if they are not home, it is a required safety inspection.
