If the sale is set for February...unless you are writing a check to pay the loan off in full, I'd say you should punt and move on to the next deal that appeals to you.It's up to the owner once it's taken back as to whether they will fix it or not.

But I'm surprised that no one has already mentioned a simple appeal to logic here:  it should be stated quietly but firmly and often that a bona fide purchaser (that is, you) is interested in acquiring this physically and monetarily distressed asset for a reasonable, already-negotiated price, and that the Brother has the choice of accepting that price, or getting wiped out and receiving literally nothing.

While the some-what guaranteed rent check every month does seem to have its appeals along with the 11-12% CAP based off the numbers I ran, I am curious what the down sides to buildings like this are?
