The police officer basically informed me because the friend has been there over a week he can't do anything and that I have to give a notice of eviction for the friend with a reasonable amount of time to vacate and if that failed(it did) to file an eviction notice with the local justice of the peace which I have done.

Anyways, in our case we felt that a court would see all this as his intention to vacate, so we cleaned up the apartment and moved on.

Depending on the laws in Kentucky and the local municipality, you could give the tenants a 60 day notice (could be as little as 30, check the local laws) to vacate the property.

I have found a screaming deal on a residential condo, but the problem is that the master dec states that it cannot be used as accommodations or residence.It is in a resort area and the highest and best use is nightly vacation rentals (VRBO, Airbnb, etc.).

If you're renting to them without a valid lease, that is, on a month to month basis, I think you should give them the month's notice required by NY Tenant Law, stating that that you are vacating the apartment for renovations after which there will be a substantial rent increase to fair market value.
