He did mention a possible alternative to the recording of contract, basically having the end buyer/investor sign something similiar to a non-compete with a penalty of whatever my assignment fee is to prevent the end buyer/investor from trying to go around me after I gave out the property address etc.

An addendum simply references the name and date of the original agreement, states the change being made, and requires agreement and signatures from all parties.If it is just an individual tenant, or family/group that are ALL vacating a single unit, a simple "we agree to let ___ break Rental Agreement for premises 3456 Main St. dated _____ and vacate on DATE without penalty (assuming that is your intent), paying pro-rated rent only for days of possession, and returning the property in the same condition as when originally rented per the move in condition form dated___.

Yes, the money isn't immediately accessible to me (I'm not 59 1/2) - and I know you can always access contributions (not earnings) tax/penalty free regardless of age, but that's another story here - but when I do withdraw funds much later in life, everything will come out tax free.
