I was looking at one in Saratoga Springs to do that also, the city said that the city council needs to approve a duplex status, and it most likely it wouldn't be approved to switch it to a duplex.

In my area, there is a long waiting list on Section 8 vouchers, tenants generally don’t want to lose their voucher status so they adhere to the program rules....not all but a lot do!

Status update:  So I opted for the title insurance and to close using there title company.  

In the divorce there will be a pretty clear process and you'll deal with all the marital assets, this one included.
