@Andrew Kerr Those are good points as my lawyers interpretation is similar that it could happen but they do differ from lawyer to lawyer which ultimately it is what is a judge to think.

Some property may have HVAC issues, and cannot be verified by a typical individual and the landlord and the real estate agent may not declare this, therefore, it is recommended that a third party verify this

People declare bankruptcy. someone going through bankruptcy would have protections from foreclosure and collections and I would imagine they may be less likely to sell unless the bankruptcy is dismissed or thrown out.

His CPA when filing his 2016 returns did a mistake by not including the stuff on Schedule E such as  "type of property" , property address, fair rental vs personal use days and simply entered Property as OTHER and declared some other nominal expenses and HOA fee etc.3.

Currently deciding where to live.I would like to know for financial and tax reasons what would be my best option, I was looking and my mom as a senior can qualify for benefits as a primary resident to her new home, all bills go under her name at the place, although haven't broken down numbers to see if it matters, the interest on the place owned with brother is 2% higher, their debt ratio are roughly the same.Where would be best to declare primary residence and choose as home, or do I even have that option, as my mortgage already dictates where is primary?
