My guess is after fixing, in this type of investment method, the buyer will refinance  and pays the owner back.

Each method has advantages and disadvantages, but the more appropriate people for you to talk to  are your 'partner' and an attorney within the jurisdiction of the property.

If you really want passive REI exposure, there are better methods ... private placements, syndications, hard money lending through a licensed broker or fund, crowdfunding, REITs, etc. would all be better options for you in that case, and at least you would be more diversified, which is VERY important IF you are going to give up control, which you will need to do in order to achieve the passivity in the investment that you seem to seek.
