You're going to get lots of different answers to this question, partly due to the fact that state laws may vary, and due to the fact that licensed agents are going to have a different perspective than unlicensed investors.In my state, a licensed agent can lose his/her license if any money flows from the seller to another unlicensed party not directly on the HUD-1.Again, this is just my state and rules made clear by my agent's broker.

Justin, I have seen this tactic a few times and from the bank’s perspective, it is good business to get some cash if things go sideways, which happens with so many deals, especially investors who just took a (bad) course.
