@Jaron Walling one that I have found the owner is in bankruptcy and the property has been sitting for a while.

My layman impression is that if both of those points are true, you get contact info on the heirs, update your files, and continue to deposit checks.If they are not paying, the key is to find out who the executor is.

File the proper notices and proceed with the eviction.

I looked at filing an amended return but it doesn't really have any line items for carry over losses from rental property from the previous year.

I would put a catch up agreement in writing and have her sign it, but I would file for eviction the second she did not execute on her end of the agreement. 

If the target property was owned by an LLC of which your family member was the only member and it did not file it's own tax return, then even though the LLC is on the deed it would be "disregarded" by the IRS. 

If you have a mortgage, then you would file foreclosure in the county in FL where the property is. 

So far, I'm pursuing a complaint with the state licensing and looking to file a criminal complaint.
