The mortgage officer will have all the facts....it's not a question of "legal"....if your banker allows it and you qualify for the loan....you'd be saving a little interest.

You tell them they must vacate and do no damage then you will not take legal action against them (I call this the easy option) and you will then either allow them to use their deposit against what they owe you and/or set up a "promissory note" payment plan - which is enforceable by law.

Also don't fall for the I do it in volume pitch... that is not real.. all contractors have contractor prices at the home depo myself included.. you get some discount but nothing over the top that allows a 25k rehab to be 15k  etc.

In order to subdivide this lot, I would have to convince the city to change their zoning map and allow for a smaller single family lot size than what they currently allow (very low odds this would be approved).
