Every state's eviction laws are very differentI did a brief search and see what the requirements are for the tenant as far as filing an appeal but nowhere did I see where you could not accept post eviction monies to satisfy the judgment you receive and still not gain possession to the property

There is only so much money coming into the tenant's possession each month and the landlord can only take so much of that or you will kill the golden goose.

He is right, the title is clear, but that is not the issue.I would start eviction as there are two units and you need to know who is there and regain possession of at least one of the units to start renovations and get some money coming in.

If the tenant has lived in more than two places within a two year period, it may indicate instability so I would require a previous landlord reference and make sure he actually owned the property.Whether or not the tenant's current or former landlords release information, we landlords are responsible for who we allow possession to our properties.Hope this helps!
