You might want to look around for a more competent party to do business with and perhaps go speak to a real estate lawyer to help you get the paperwork you need and rely less on the loan originator doing a good and proper job.

I'm no lawyer, but I would bet you could have some serious charges for knowingly allowing such things on your premises.  

If you can get in good with a private lender (Doctor, Lawyer etc....) and you can develop a continued relationship with them, you wont lend a lending institution to lend you money.  

It pushes them to finish faster which decreases your carrying costs.Get a good lawyer that focuses on development (not just real estate transactions).  

Wood is a tax lawyer with a nationwide practice.
