Does a seller have to treat their home if there's evidence of treatment of wood destroying insects?

HiThe contractor acknowledged damaging the wood banister when installing it to the wall but denied scratching wooden doors. 

I tore the side steps off, replaced all the wood from the ground up, back porch only needed the decking boards.

The wall was made of wood btw.
