In CA I prefer the LP structure because of the high state fees for LLCs that produce a high level of income, but you should check with your tax advisor for specific entity selection advice based on your income and tax situation.

At this point you may be dealing with an attorney or usually it will be just a friend or relative, an average Joe who was selected to settle ones affairs.Either way, the probate court approve the sale, either the Administrator or the Executor asks for approval of the sale of real property unless the court has all ready granted the authority to sell.
