Send infraction letter, (and copy of photo) to the tenant, include in it 'immediate cease and desist', and inform them of your obligation to inform the proper authorities.

Does it include demo work like walls in there or is it all just material items from previous owner. 

Your time includes moving, painting, spackling, demolition, hiring contractors, finding a listing agent, staging, etc. 

Likely an easier "sell" to raise the base rate PSF on the 1,623 SF ever so slightly to include use of the patio.
