If this is an experienced sponsor with a long track record there may be some language in the contract that is open for interpretation and he/she is taking advantage of it, If it's a new sponsor they may just be greedy.

A lot of rehab/flippers put language in their contracts to encourage buyers to utilize their lender similar to how new home builders put restrictions on buyers with outside lenders by writing:- more restrictive contingency dates- monetary incentives to use their in house lender- quicker close dates- required prequalifications by the in house lender- higher earnest money deposits required- verification of funds to close, proof of credit, and Income documentation- etc

The PG county website has the following language: "Basements or portions of basements shall not be used for bedrooms or as a habitable space unless authorized by the Enforcement Division of the Department of Permitting, Inspections and Enforcement."

If I include in rent, I make sure is a bonus, language in contract if it breaks or need maintenance is up to the tenant to fix, or they can get their own, I haul off the old one.
