It's what is called the procuring cause.If it came down to arbitration and the listing agent won, you would have to pay your friend out of your pocket or your friend would be out of luck.Best case scenario:The listing agent says nothing more about the topic, your friend submits the offer and everyone moves forward.

You also have the options to procure hard money (probably not the cheapest option but they don't have as many regulations and requirements) and non-traditional funds. 

@Dennis Montai If you did not have a buyer's agent who helped procure the sale then it was the listing agent's efforts that got a buyer.

You will be on the hook to pay them for procurring you LOL.

Tony Karns - are you sure a commission wouldn't technically be owed to the first agent for showing you the property and bring a procuring cause of the offer?

As well as a sample contract to an investor after your procured the property? 

What I would like to do would be to acquire the land and build the home and then pro cure a USDA loan for the property and home.

We charge 1 month's rent to procure the tenant, and we charge 8-10% per month to manage the property.
