i understand about using all the expenses to help offset the income generated by the property, then with depreciation, you may end up in a "paper loss" position for the year....which depending on your W2 income, may be deductible.

Still in her Maiden name, even though on paper she took her husbands last name, her Maiden name still is connected with her. i am not a lawyer, but i would think you are ok, but it also wouldn't hurt to have them both sign the lease with the new name, just explain to them that you were told you have to do that to update your records.

The same problem exists if the driveway was placed on the other side of the Lot, though that adjacent owner's driveway placement is correct according to the driveway layout plan.
