Even if you follow the standard documents exactly, you should see an attorney in the location of the property. 

A legal ADU must have: a sleeping area of at least 77 sq ft with a closet (it can be a "studio" apartment), a bathroom (with its own sink), a cooking area (with its own sink), and then standard egress/ingress sizes. 

If things continue after we discover  who does it, we think to liquidate our laundry room, we want to keep our place safe.

A standard EMD in CA is 3% of the purchase price and for purchase prices of $10k, as a seller, I would want to see at least 5%. 

They are asking $59k ”As-Is.”I wasn’t able to find any standard comps (.5 mile radius, time sold, same beds/baths, etc.) but I used Redfin and they had similar homes that had sold in the area.

You might be able to avoid the attorney fees by using a simple, standard FNMA note and have a title company close it.

Glad I found and joined the BP community, only wish I had discovered it when I first had rental properties.
