All things equal LLC is always a better option it takes just 2 forms to start one (one for IRS one for the state) but I believe the op is asking if it is kosher and if there are any special steps to take before setting up an LLC while still having a mortgage on the property in his name and also residing at the property.

Obviously if there's an emotional attachment there must be an equally strong or stronger motivation for him to even consider selling.When he pushes again, remind him that you're trying to work towards a common goal and that in order to achieve that goal and help him, you can't give him any more on the price.Dealing with sellers you have to be strong saleswoman and a strong negotiator.
