I also have language that I can solve schedule issues by buying material directly and hiring other contractors and all those expenses come out of the contract amount to the delaying contractor.

My refinance has language that we must occupy the property for 12 months post refi, so this has to be viewed as an investment property from a financing perspective.

I would ask your attorney for details on this, but theoretically, wouldn't official, sworn testimonies or affidavits from your tenants stating that they complained to the seller about these issues and he acknowledged them, etc...
