One of the strategies that my property management team currently does to try to generate more PM leads is that we send out mailers to any expired and sold multi-units on the MLS.

The issue will hopefully be cleared up before you want to sell, but you're taking on the risk that it won't be.For these reason, I'd pursue the ADU, maybe pursue the addition, and ditch the JADU idea.

They stop paying and now you have a bigger issue on your hands.Are you saying these tenants have been in these units since the 70s or are you assuming?

It's a state licensing issue most likely for the agent/agency.

As a landlord, how specific do you get and at what point, if any, does tenant become responsible fro treating the issue (other than communicating to the landlord of issues). 

Most of them won't issue the loan if its a small amount though so be mindful of that.
