If all that passes the smell test, it sounds like you should pull the trigger.

If we eventually decide to pull the trigger on investing abroad I will still be playing an active role by spending atleast 3 months of the year in the country.

So when a borrower defaults in some way, you can send him a notice to accelerate, which demands payment in full while also triggering the default rate of interest until the note is paid off.

They probably have a lien on the property and if they transfer title, it will trigger the due on sale clause, and assuming neither of you have the money to cure the lien, the lender would foreclose. 

After many years of saving I think it's finally time to pull the trigger on a multi family building later this year.  

I want to do this but am concerned that if a lawsuit ever happens that they'd still be able to find a way to my partners and my personal assets.Secondly, I believe this would trigger the 'due on sales clause' in my mortgage.

If we get any small piece of the property sold we have an investor willing to pull the trigger on the remainder of the land.

I am thinking of suing myself in small claims to "trigger " a loss and then put a claim into my title insurance company.
