As of right now, I will be filing for an eviction.

I made an offer on this property yesterday and just received a call from my realtor letting me know that she is filing for an extension for the seller to respond to the offer. 

The next time they are removed, I file for eviction. 

However, I wouldn't feel a need to hire an attorney or surveyor, unless and until a lawsuit is filed.

Once it's pending and has been set and docketed at the courthouse, the homeowner can accept an offer, but it would still need to be approved by the bank if there have been lis pendens filed.

You can file a claim with your insurance company for the damage from the backup most likely.That line belongs to them.
