One other thought - some banks want to know that you didn't borrow the money used for the down payment, and will ask where the money came from or check to see how long the money has been in your account.

If she goes the route of canceling I would hold lender liable for the EMD (I assume this was waived) and also hold them to crediting the appraisal fee too.
