If we end up in court will the judge see that this is in fact a "Just Cause" eviction based upon our correspondence and evidence and that I simply made a procedural error in not submitting the proper notice?

You can go the route of filing in court and hope that motivates him to pay, but it's likely just going to cost you more out of pocket with no positive result.I would tell the tenant what the right thing is, then wait.

Thanks for sharing.I do most of the same but I do not want them to apply.I takes to much effort to review the app prior to pre screening.Every potential tenant has to answer prequal questionnaire first.Then the visit is scheduled for those that qualify.Then the app, if they appear to be most qualified based on their answers and initial in person screening.Just like a job interview.

With a lot of offers coming in on many properties these days, accepting such letters does open the possibility of exposure to discriminating against any number of protected classes of people or the appearance of doing so.
