I was trying to place the earnest money check with escrow, and then have it remain un-cashed until my contingencies were removed.I got opinions from three different attorneys because I wanted to be able to sue for specific performance if a seller backed out of a contract.Each said my chances of winning a suit for specific performance where basically zero without cash consideration.

This gives the contractor a reason to complete the job to get the remaining 10%, and it protects you in the job is not completed completely, you can terminate the contract for non-performance, and you still have 10% of the original contract in your pocket to hire someone else to finish it.

I think you are correct, a lot of investors including moi, took serious hits on their investments, credit over the past few years, most investors do not want to talk about this, they would rather paint a rosy picture about real estate investing, but I think that is part of life, in terms of credibility, if your investors lost money with you, the only think you can do is what you are doing right now which is to try and make them whole, I think your credibilty will remain intact as long as you are doing the right thing(easier said than done) keep your head up, this too shall pass.

Back to my interpretation:From my understanding there are restrictions on what a Family Owned company can own, specifically in excess of I believe 4 units in a particular property, to be considered remaining as family owned.
