I'm not sure why anyone would revive this old thread since it contains guesses and suppositions that people were making over a year ago before every state trade association and national trade association got on the same bandwagon based on real facts and not loose suppositions that people were hoping were right.Rent to Own and Lease to Own (of manufactured homes) are viewed in every state as disguised credit transactions and those so engaged are required to hold a state lending license and follow state laws regarding lending.

I called the police on the druggies while I was at the property and had the druggies arrested for trespass, open container, and other minor crimes.

Because the TILA definition of dwelling is used and TILA defines dwelling to mean "a residential structure that contains one to four units, whether or not that structure is attached to real property", the SAFE Act requires that the individuals who originate these types of loans must be licensed.According to DFI, you would not need to qualify under the mortgage broker act as you are not brokering a loan, but instead providing the financing yourself.
