The burden of proving you have followed the regulations precisely falls on you. 

One classifies a property as strictly VRBO and they have capped the number of those licenses (currently at 66, I believe). 

@Fan Bi I actually was thinking about this further this weekend, and although I wouldn't do anything differently - the ONE thing that comes to mind is that I would be better to invest outside of NY because the landlord tenant laws are so strict here and can be difficult to navigate at times.

Also, the MLS in most states has pretty strict rules about advertising a property listed on the MLS, so I am not sure how the wholesaler then goes about doing that without liability. 

I strongly suggest reading your local laws regulating landlord entry.
