@Reece O'Bryan - This applies to pretty much all loan types, but yes you can use 75% of rents from legal units to qualify for the loan.

When you say he is on the paper work ... you mean you used his credit and finacials to qualify for the loan.. and he is as stated an owner of record.If you can't work it out.. a mediation service may work well for you.. your not the first one to go through this stuff.. you also may be deem married in common law.. depending on your state so the break up would be handled just like you were married.

But with an income of only 30K, I'm not sure if I am going to qualify to keep the house in CA (which is valuing at an outrageous rate right now) and also buy another property to live in.

So, if the property is...unique...and doesn't qualify for a conventional loan, a portfolio lender may decide the issues are no big deal and make the loan.If nothing else, you can at least plead your case to a portfolio lender!
