You may be able to apply for a variance that will allow your to subdivide but thats going to cost money for an attorney (if needed) and an engineer to propose plans etc..You should talk with the township zoning folks first if you havent already.

I set my bar 200 below zillow and rentometer, I do not know what other sites to use to check rent rates.I submitted my proposal back to the seller to get about 400 per house, I eventually want to settle out at 300 per house and I think I will pull the trigger if the inspections come back ok.

Right from after the time I showed interest in making an offer, he has been stylishly telling me to make high offer as the area is expensive - so he said but I objected and made an offer through him for an amount 25k less than what he proposed.

Even if there is no transaction or exchange of value in a joint venture such as proposed, there could be the indirect benefit of the access to $90K of personal capital enabling the $10K of 401k capital to have a deal to participate in.If an IRA (or disqualified party) can engage in a transaction on its own, then choosing to joint venture in such a format would likely be OK.If either party could not under reasonable circumstances engage in the transaction on a stand alone basis, then there could be issues of benefit.So, say you have $100K in a 401k and $100K liquid personally, and want to invest in a $150K property.
