It sounds like the seller might have known about this all along although you will never know.We would make earnest money non-refundable only after certain contingencies have been removed.Going to court you can be 100% right and only have an 80% chance of winning.

The Disney area isn't really the most favorable location for them, but at an attractive price, it could be a win-win.Also take note of management companies.  

If you are buying for cash flow in work force housing neighborhoods and you can purchase the asset at a price that makes sense you will win here in Houston.
