However, to specify that it needs to be clean, and then later change the policy to "awww, don't worry about that, we're going to charge you either way" definitely feels wonky, but other than the possibility of simple Good Faith refund I wouldn't give it much more effort.

It seems People put too much faith in doctors and lawyers giving them a god complex many times that is undeserved .I think it’s a good idea to have a lawyer , I’m not against anyone using a lawyer and couldn’t fault anyone for seeking competent legal counsel ,I’m just saying if it’s something I can do feasibly with a reasonable chance of success I will make every effort to do it .

Just because you have an out in the contract that says if you can't find a buyer, the deal fails, doesn't mean you are entering this contract in good faith.
