That violates the Takings Clause.MD can be distinguished (in fact MD was mentioned in the decision) in that there IS a process on the books for the foreclosed owner to petition the court for the surplus.

If you think about it in any industry less transparency and more friction in the transaction will increase fees/commission vs reducing them.I like the idea as an investor of having different agents, a team of agents maybe 3-4 bringing me deals, but I think less of that will happen now as all will have to have you sign some kind of agreement up front.

The only place this would appear to make sense is in Class D neighborhoods which could cash flow.You have rights to income but nothing else - sounds like an unsecured note at the end of the day. nail on the head  very few in our generation really understand the whole token thing I tried reading a book on it and I still have no clue..
