@Mike M.I just started an LLC and I want to do it for asset protection purposes but I want the lowest possible rate, and I know LLC's may not offer the best rates to help lower the mortgage payment.

I can't speak to the legalities of this situation but one of the issues is if the utilities are off the pipes can freeze so you need to keep this in mind if you don't keep them on you need to protect against this.

Search on LLC and you'll see what I mean.Some believe in the protection, others say its only protection if you are not involved as the manager, others propose trusts and other legal manipulations.Commonly for the first property it is not considered necessary.Not Legal Advise.

That way a servicer is crossing all the t's and dotting all the i's on applying payments to the balance and doing end of year statements and communicating with the borrower in the ways outlined in the law.If you're an entity, you can do 3 such seller finance deals with no LMO requirement, but you are required to do an ability to repay verification.All of this is clearly spelled out in the Consumer Finance Protection Bureau's ruling and letters on this issue.

I'm asking this out of pure protection concerns, cost is not an issue as I have found my friends Insurance Company is able to keep the commercial premiums the same as the residential policies.

This is not like residential leases where there are protections for the lease, it over, bye, bye.A regional eating place in Pittsburgh just closed two of their locations because they could not reach terms with the landlord, lease was up, there is no agreement, the places closed.

The buyer can decide to buy or not buy during the term of the option contract.Attaching a PA to the option is pointless.The buyer is already protected with the option which obligates the seller to sell.
