I know that is slightly risky as the bank can invoke the "due on sale" clause, but I will be able to get a hold of the money if I need to, so I'm comfortable taking that risk.

You can certainly try other lawyers, you have no duty at all to use the one your realtor wants you to, but if you don't have someone you prefer and you feel comfortable with that lawyer after talking to him or her, go for it!

On the other hand, if you are comfortable in your current situation-maybe the extra risk of being highly leveraged is not worth chasing higher returns.Hope this helps!
