They may not come close to being similar to what you are considering once you thoroughly investigate the property and the target market.As for what type of contract, you should consult with a Texas attorney to make sure all the legal requirements are addressed and your interests are fully protected.The current $65,000 lien holder may not want you to assume the loan, especially if the interest rate is less than current or predicted market rates.

Verify payment history with an individual holder, you need to see the deposits otherwise that can be fudged, credit is determined as to the deposit date, not a date claimed to be received.

If you have a new loan and high ltv, there isn't much to protect in my layman's opinion because if the property was ever forced to be sold, the Note holder has the first lien position.

According to Jerry Norton, you then send the note holder a Referral Fee Agreement wherein the note holder agrees to pay you a fee of 3% - 6% for your bringing in an end note buyer who successfully closes the deal.

Never missed a payment and I was served strange demand letters after demand letters from the Note Holder ( 92 year old lady) My wife was 7 months pregnant at the time.
