They were advertised as non-smoking, we asked if anyone smoked, but did not refuse to rent to a smoker, they just smoked outside.

It doesn’t smell quite like marijuana and I know the male tenant smokes but he’s kept it outside, as required by our lease agreement.

At each meeting we:- Spent a few minutes getting to know them - Walked the apartment- Checked the toilets for leaks (I pay water)- Asked how they liked their neighbors- Asked if there were any current issues with the apartment - Discussed our non-negotiables: take care of the apartment, no smoking, no pets, and pay rent on time (those in leases were already bound to these items)- Explained our process for maintenance requests and our hours of operation - Explained their options for paying rent (Cozy or mailed check)We then followed up each meeting with an email containing a summary of what we discussed and any follow-up items (maintenance).

The silver lining in all this is that you regained possession and now you can go in and clean house.I am super excited on my eviction as we were just granted, "Judgment for Plaintiff via Default" So in 5 days I can have the marshall knocking on the door with a 24hr notice.

You can put a clause in your lease that says no smoking, but you would have to prove they were smoking.
