I have a friend that avoided a lawsuit because he used a trust and the case apparently wasn't strong enough or worth the money to try and go through it. 

If my city of 60k had to pay off a lawsuit to the tune of millions of dollars, chances are my taxes would go up and my property values would drop.If we were one of only a few houses that were impacted, it would be a different story.

If you or the business cannot justify the expense to have a lawyer draw up proper docs, both you and your business are probably not attractive targets for a lawsuit. 

You might find yourself in a lawsuit if you are acting in the capacity of an agent but not acting in the best interest.

Most likely the state where the property is located is where lawsuits would be brought if they are something for personal injury like a trip and fall or something of that nature because the “cause of action” arose in that state.

Secondly- mortgages act as asset protection and may thwart law suits.

Some areas to consider (MFR: Little Havana; Hollywood; Westchester); SFRs (with in law suite): Shenandoah; El Portal; Hollywood.

My understanding is this is still a grantor trust, and I don’t think it’s going to offer any protection in a lawsuit, but ask an attorney for a real answer on that  All I can suggest is don’t make it overly complicated.

Not doing this can lead to fines, or, even worse, if the LLC is involved in a lawsuit, it can be disregarded because it is not registered to do business in the State.
