The attorney though appears to have advised you on what could happen, including the ex husband making a claim to the property post closing. 

Our state (Virginia) doesn't seem to allow Series LLC's, so that appears to be an obstacle (at least from what I have researched). 

This problem might not be as bad as it appears.
