So that way they can force the owners to submit any and all requested paperwork; the lender is hoping for some signs (assets) that indicate whether these owners would be worth pursuing in such a lawsuit.If the approval happens first, there is no longer any reason for these owners to cooperate ...The lender might also be looking to get the owners to sign a promissory note to cover part (or all) of the deficiency.

They can use a partitioned note and sell part or all of the principal to obtain needed funds for their next deal if the down payment is insufficient, but disounts can be deep and the buyer needs enough equity when it is time to refinance the obligation, so playing with the sale price to compensate for the discount can be hard to do in reality.

The purpose of the legislation was to free agents and appraisers from outside undue influences to arrive at a specific value or cutoff amount to make a deal fly, so keeping that in context should allow some leeway to reasonable communications and assisting with suggested comps.
