I am excited about all of the resources on this site and look forward to engaging with people and sharing my thoughts and learning from others experience.

I believe the judgment was for $45 MM, whereas the LLC only listed assets of $1 MM, so there is a very limited loss, especially to Kyosaki who's personal holdings are protected since the LLC engaged in the business activities and BK.Long story short, BK doesn't build wealth.

I would not engage a lawyer.  

My only other concern is that this deal will likely get dragged out for months and months, so I run the risk of tying up EMD forever, but I guess is not much different than engaging in a short sale.  

Especially with really coarse paper having the drum engaged when still WILL result in a groove in the floor that you will NOT get out.

If you bought the property all cash, you will engage lenders and explain you're looking to cash-out refinance and they will guide you through the steps.

If there are any seller finance/subto experts around Greenville, NC willing to help me engage and lock down this seller under contract I’d pay for the assist!   

Hi Cassandra,I'm happy to discuss some of the options with you (currently working on multiple 1031 exchanges throughout San Diego County) but this is very critical and you should engage an exchange accomodator before thinking about your 1031 exchange to make sure everything is done properly and you don't end up with an unexpected tax liability.
