As far as the framing goes, the water can have no effect of the wood (other than water staining) as long as you dry it out and treat it appropriately.

At the end of the day the junior lien holders still have the same rights and need to be bought off or foreclosed off, no matter what you're doing with the first.The situation seems pretty cut and dry to me, you either buy the note and foreclose or get the bank to foreclose and buy it from them.
