So this is a great opportunity for you.You can continue to rent that property and as long as you close it's sale within 3 years of the time you moved out you can still claim that you have lived in it for 2 out of the previous 5 and take that profit tax free with no reinvestment requirements.

If you can sue in small claims court without benefit of an attorney at minimal time and energy cost, it's worth doing just to document what's happened, that you have some sliver of collecting, and protecting future landlords who check on these things.
