Yes he can go after you in court for damages even if you didn't give him a security deposit but he is only likely to win if  it was extremely negligent of you.

Then, when things blow up, they go to court, charging you again, and you lose......but they win.

This gets weird because now you're forcing them to speak to a pre-recorded message the minute they answer the phone which would instantly irritate most people.How do you break through that barrier? 

I think when you take what seems like easy money (debt) off the table or at least not the first response it makes you much more creative and requires you to dig in and think a lot more looking for win/win opportunities.  

If the deal is indeed this good and is a win win for everyone, I don't see why another buyer/rehabber won't bite.
