I do not work at Bank of America and am not authorized to speak for them, but for a prominent "household name" example, based on "BofA said I couldn't get a loan because...." questions I get from folks, I'm 99% certain that BofA is a "Fannie shop," or at the very least their loan officers are only trained on Fannie.

When the loan mod was agreed to (you mention the 2nd is re-performing), hopefully, the investor who owned the loan at that time required the payor to sign a limited power of attorney (LPOA) granting authorization for the senior lien holder to share information with the junior lien holder.

It appears that the “lender” is servicing the note but has no authority or no funds to fulfill the draw request.This is a situation where it behooves a borrower to have looked beyond the terms of interest rate and loan to value to see if an escrow account had been established and who has authority to release money from the repair escrow.However, you may not be without recourse.
