I like this because it keeps everyone honest and doesn’t put anyone in a compromising position.To be even more formal, and total overkill for your loan, there are construction fund control companies like Hasz that will hold the money and also perform the construction inspections, so your lender knows these were done per code, with formal lien releases, etc.

I love the pomp and circumstance, the celebration, but trying to gain it is miserably slow at best.I'm a decade and a half into that journey with little to show for it, and I'll spend three and a half more if necessary with nothing more to show, but I sure hope the gods of luck and fate cooperate eventually.

WE pay the suppliers direct and hire the GC on a fee basis.. and of course we DEMAND lien releases other wise no other draws will go out..

I tried to proceed per usual by using an assignment contract to "sell" them the Purchase and Sale Agreement, but I quickly learned that the 1031 exchange agent needed a Purchase and Sale that says $450,000 as the purchase price in order to release funds - the assignment contract didn't fulfill this as the assignment is stated as an additional "fee".

They had me sign a release form the very next day after I paid the retainer, so the brokerage could release the funds to the agents.

That's where I would start.That 2nd likely matures in 2035 and won't expire for a period of years after that and if that's the case it's a lien that needs to be paid and released in connection with a sale or refinance.
