Under F.S. 83.595, landlords have 4 options when a tenant terminates early, one of which includes charging the tenant an early termination fee (no more than 2 months' rent), but if your lease agreement does not provide for liquidated damages upon a tenant's early termination, you have only 3 options as a landlord.

If you sign a year lease with these folks, you have no way to make them do anything at the 5 month mark because you are in the middle of a 1 year agreement. 5.

Do you have an agreement to use?  

Although I would like to try to do it myself, crafting effective operating agreements is outside my comfort zone.

We offer our residents the option to terminate their agreement with just 2 weeks notice.

However, I'm not sure how robust our operating agreement is. 

In my area, most agreements state that the closing costs are split equally between buyer and seller, but sometimes one party will pay everything.

You can easily incorporate language into your agreement of sale that allows the transfer of the sales contract to an LLC that has not yet been created.
